Terms of Service

These terms govern the use of Cheke, a point-of-sale application for small and medium businesses, operated by Mica Go Store LLC, a Texas limited liability company. By creating an account or using the service, you accept them.

1. Eligibility and account

You must be at least 18 years old and have the capacity to enter into a contract. You are responsible for everything done from your account and for keeping your password safe. If you give access to an employee, assign the role that fits: permissions exist for that.

Every business must always have at least one active user with the Owner role. This is a system rule and cannot be bypassed.

2. Description of the service

Cheke lets you record sales of products and services on the same ticket, keep inventory and costs, manage work orders, reconcile cash and calculate employee commissions.

Cheke is currently in a pilot phase. That means it may have defects, some features are incomplete, and the service may be interrupted without notice while we work on it.

3. Plans, billing and cancellation

During the pilot phase, use of Cheke is free of charge. There is no subscription, no payment method on file and nothing to cancel.

If Cheke becomes a paid product, we will tell you in advance, and paid plans will only start with your explicit acceptance. You will never be charged automatically for continuing to use what was free.

4. Your content and ownership

Everything you enter — your catalog, your customers, your sales, your inventory — belongs to you. We claim no ownership over it.

You can request a copy or its deletion at any time by writing to mc@micagostore.com. We use that data only to provide the service, on the terms of the Privacy Policy.

You are responsible for having the right to enter the personal data of your own customers and for how you use it.

5. Our intellectual property

The Cheke software, its name, its logo and its design belong to Mica Go Store LLC. Using the service does not transfer any rights over them. You may not copy, decompile or resell the application.

This matters and should be clear: in its current version Cheke issues a simple receipt, not a fiscal document with a CAI authorized by Honduras's Servicio de Administración de Rentas.

Meeting your tax obligations — invoicing, filings, withholdings — remains entirely your responsibility. The tax figures the application shows are an operational aid, not accounting or tax advice. Consult your accountant.

The same applies to the rest of the numbers Cheke produces: costs, margins, commissions and cash counts are calculated from what you enter. Verify them before making business decisions or paying your staff on them.

8. Third-party services

Cheke runs on infrastructure from Base44 and supports sign-in with Google. Those services have their own terms, and we do not control their availability. A failure on their side may affect Cheke. The full list is in the Privacy Policy.

9. Termination

You may stop using Cheke whenever you want and ask for your data to be deleted. We may suspend an account that breaches these terms or that puts the service or other businesses' data at risk; except in an emergency, we give notice first.

If we discontinue the service, we will give you reasonable notice and a way to export your data.

10. Disclaimers and warranties

Cheke is provided as is and as available, with no warranty of any kind, express or implied. We do not warrant that it will be uninterrupted, error-free or fit for a particular purpose.

Because the system works online, if you lose internet access you will not be able to charge. Take that into account in your daily operation.

11. Limitation of liability

To the maximum extent permitted by law, Mica Go Store LLC is not liable for lost profits, lost sales, loss of data, indirect or consequential damages, or business decisions made on the basis of information from the application.

Our total liability for any claim will not exceed the amount you paid for the service in the twelve months prior to the claim — which, during the free pilot phase, is zero.

Nothing here limits liabilities that the applicable law does not allow to be excluded.

12. Indemnification

You agree to hold Mica Go Store LLC harmless from claims by third parties arising out of your use of the service, your breach of these terms, or your handling of your customers' personal data.

13. Modifications to the service and terms

We may update the service and these terms. The date above indicates the latest version, and if the change is significant we give notice inside the app or by email. Continuing to use Cheke after that means you accept them.

14. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute will be submitted to the competent courts of Texas.

This does not deprive you of the protections of the consumer law of your country of residence where such law grants them without possibility of waiver.
